L'Etat et la 'sanction du marché' : l'expérience de la faillite

Abstract

La faillite n'est nullement une règle endogène au marché. Au contraire, elle est solidement établie dans l'espace institutionnel et juridique de l'Etat qui assure la pérennité de l'ordre contractuel en lui permettant de surmonter ses propres crises. Cette procédure permet de comprendre qui peut entrer sur le marché, comment on en sort, ce qu'est cette frontière, qui la surveille et pourquoi elle est si importante pour la société dans son ensemble.
