Abstract

This document analyzes the legal obligations of employers in New Caledonia in the face of the increasing natural risks linked to climate change. The author emphasizes that, despite the absence of explicit legislative directives regarding climate disasters in the local Labour Code, companies remain bound by a general obligation of safety toward their staff. The study examines the consequences of a disaster on contractual relations, particularly the management of economic redundancies and the limits of the force majeure argument. It also highlights the inadequacy of current preventive tools and the need for managers to anticipate these hazards to protect both employees and the economic sustainability of their activities. In conclusion, the article calls for an evolution of the regulatory framework to better support island businesses facing these growing environmental challenges.
