Abstract

Nouveau revers dans la première affaire de sanction pour pratique anticoncurrentielle de l'Autorité polynésienne de la concurrence (APC). La cour d'appel de Paris a en effet donné droit à la requête en suspicion légitime formée contre M. Jacques Mérot, alors président de l'Autorité, dans l'affaire « des frigos », au motif que son comportement a été « de nature à porter atteinte à l'impartialité ou à tout le moins l'apparence d'impartialité de l'Autorité polynésienne de la concurrence dans son ensemble » (Paris, ord., 29 juillet 2020, n° 20/08122).
