Abstract

La médiation n'est pas qu'un mode de prévention ou de résolution des litiges, elle est bien plus : un mode pacifié de régulation sociale qui connaît un réel engouement en droit, en psychologie, comme dans d'autres domaines, tels que l'économie ou la gestion. Pour autant, un certain flou conceptuel entoure la notion, notamment parce qu'elle se décline selon des modalités extrêmement diversifiées, qui se développent dans des champs disciplinaires très variés. L'intérêt de son étude est encore renforcé par le fait que la médiation s'invite dans tous les aspects de la vie sociale ou presque : justice, entreprise, administrations, famille, villes, école…. Or, la médiation donne généralement lieu à des études segmentées. Cette journée du 16 décembre 2019 a pour ambition de proposer d'étudier la médiation dans sa dimension interdisciplinaire, et de transcender la juxtaposition des regards croisés autour du phénomène « médiation(s) » afin d'analyser les raisons de son succès, et de déterminer s'il s'agit d'un phénomène unique au-delà de ses déclinaisons plurielles. Dans cette perspective, l'analyse poussée du processus de médiation s'impose, et les débats se termineront sur les possibles perspectives d'amélioration de ce mode de régulation sociale.
