Abstract

L'organisation juridique de l'exploitation agricole peut être envisagée comme l'expression du mouvement relatif de deux institutions, l'entreprise, assurant la valorisation d'un capital, et la famille, assise sur un patrimoine comme moyen de sa perpétuation. L'examen du statut des baux ruraux, de la politique des structures et d'installation, et des principes de fonctionnement de la Politique agricole commune (PAC), montre l'émergence d'une rationalité d'entreprise par altération de la logique patrimoniale préexistante, et en retour l'asservissement de l'entreprise à une finalité patrimoniale. Cette recherche met en évidence le peu de consistance du concept de patrimoine dans l'analyse économique, en écho à sa réduction individualisante dans son acceptation juridique.
