Abstract

L'objectif de ce chapitre des d'analyser, dans le domaine des biotechnologies agricoles, comment l'évolution conjointe entre organisation de la recherche et propriété intellectuelle dans les dernières décennies peut permettre de construire l'organisation de la recherche de la propriété intellectuelle de demain. Dans un premier temps, l'auteur explique pourquoi les ressources génétiques sont passées du statut de patrimoine commun de l'humanité à un statut de bien privé ou club. Ensuite, face aux effets néfastes de ce changement de statut, l'auteur analyse les réponses qui ont été apportées au niveau des institutions internationales et nationales. Enfin, il explique comment les acteurs eux-mêmes ont proposé des alternatives qui conduisent aujourd'hui à réfléchir à de nouveaux statuts pour les ressources génétiques et les inputs de la recherche : la définition et la création de biens communs.
