Abstract

Infolge der Finanzkrise erließ der deutsche Gesetzgeber das Kreditinstitute-Reorganisationsgesetz (KredReorgG) mit dem Ziel, künftigen Krisen in der Kreditwirtschaft vorzubeugen. David Rapp be­trachtet die im KredReorgG enthaltenen Sanierungs- und Reorganisationsregeln für Kre­ditinstitute erst­mals aus einer betriebswirtschaftlichen Perspek­tive. Der Autor zeigt auf, daß die gesetzlichen Vorgaben zur Einleitung des Sanierungsverfahrens aus betriebswirtschaftlichem Blickwinkel als verfehlt an­ge­se­hen werden müssen, und präsentiert einen innovativen Ansatz zur Sanierungseinleitung. Zudem ent­wickelt er ein investitionstheoretisches Modell zur gesetzlich geforderten Entschädigungsbemessung im Falle einer in der Re­organi­sa­tion einsetzbaren Umwandlung von Fremd- in Eigenkapital.
