Dynamique des marchés et ajustement de la protection intellectuelle

Abstract

Si au premier abord la protection intellectuelle peut paraître antinomique avec l'objectif de maintien de la concurrence, cet antagonisme s'estompe si l'on porte un regard ‐ dynamique cette fois ‐ sur l'évolution des marchés et la concurrence qui anime les entreprises visant à introduire de nouveaux produits. Dans les marchés caractérisés notamment par une forte incertitude concernant le niveau de la demande à venir, l'analyse économique montre que la propriété intellectuelle évite que les entreprises ne s'engagent dans une « guerre d'usure » inefficace. Dans les marchés caractérisés par une croissance et une incertitude faibles, il peut même être socialement optimal d'accorder à l'innovateur une protection intellectuelle assez forte pour repousser indéfiniment l'entrée d'une offre substituable afin d'exacerber la course à l'introduction d'un produit nouveau.
