Abstract

Res nullius lorsqu'elle est sauvage, res propria lorsqu'elle est domestiquée, c'est surtout cette dernière, l'abeille mellifère, qui est appréhendée par le droit – et encore par le seul prisme de sa colonie, de son habitat, la ruche, et de sa production • Au-delà de sa production directe (miel et autres), est désormais valorisée sa production indirecte, la pollinisation, au point d'être saisie par la pratique contractuelle • La prise en compte récente de ce service écosystémique n'est toutefois pas suffisante pour assurer la conservation des espèces rares et menacées • Au-delà d'une protection spécifique de l'abeille, une préservation du milieu de vie des pollinisateurs – et du nôtre – est aujourd'hui nécessaire.
