Abstract

L'article propose une photographie au plan international du risque concurrentiel en matière de cartels transnationaux et identifie deux tendances. Celle du développement du Private enforcement qui en Europe rencontre une forte opposition, porteuse d'un Forum shopping. Et celle de l'engagement de la responsabilité pénale des dirigeants dans nombre de pays post industrialisés, comme de pays émergents, en raison de l'absence avérée d'effet dissuasif des seules sanctions à l'adresse des entreprises, ce malgré un durcissement universel des sanctions à l'adresse de celles-ci.
