Implications des licences FRAND pour la concurrence : un regard économique

Abstract

Alors qu'une prochaine génération de téléphonie mobile commence à être déployée, promettant des applications dans de nombreux autres domaines, nous portons dans cet article un regard économique sur les accords de licence qui gouvernent l'implémentation commerciale de technologies brevetées inscrites dans une norme technologique comme la 5G. Lorsque le processus de normalisation engage les entreprises titulaires de brevets à offrir des licences à des conditions dites FRAND (« Fair, Reasonable, And Non‐Discriminatory »), l'approche économique permet d'identifier divers mécanismes ‐ dont l'embuscade de brevets, le « hold‐up » et le « hold‐out » ‐ qui peuvent perturber le fonctionnement concurrentiel des marchés, et réduire les incitations à innover. Mais il reste à faire émerger un consensus suffisant pour que les pratiques des organismes de normalisation évoluent, sous peine que les acteurs du secteur des technologies de l'information et de la communication (TIC) ne se trouvent engagés dans une nouvelle série de conflits juridiques.
