Abstract

Soumis à une obligation de non-cumul d'activités et de rémunérations, les agents publics peuvent depuis longtemps percevoir les rémunérations liées à la production d'une oeuvre de l'esprit. Cette faculté des agents publics, bien connue des universitaires, constitue un véritable droit puisque les agents n'ont ni à solliciter l'autorisation de leur employeur, ni à respecter un quelconque plafond de perception. Toutefois, ce qui ne pose guère de difficulté lorsque la création se produit dans la sphère de la vie privée constitue un point d'achoppement du droit de la fonction publique avec le droit de la propriété intellectuelle lorsque la création s'effectue dans le cadre de l'exercice des fonctions
