La territorialité des lois : une fiction ?

Abstract

La mondialisation a abouti à un effacement des frontières, plus ou moins visible selon les domaines. Effectif pour les relations commerciales et financières, évident pour l'information et la technologie, mais très partiel en ce qui concerne la circulation des personnes, comme en atteste la crise actuelle des migrants. Cet effacement des frontières n'a pas mis fin à l'existence des États-nations, mais a affecté la souveraineté des Etats, soit par transfert assumé de souveraineté à des entités supranationales - cas de l'Union européenne ou de la zone Euro, soit, de facto, aux marchés, par la dérégulation.
