Abstract

Le management public ne s'est pas développé en France en marge du droit : il a agi sur l'ordre juridique lui-même, d'une part en contribuant à faire évoluer le contenu des règles applicables à la gestion publique, d'autre part en soumettant le droit à un impératif nouveau d'efficacité ; la « juridicisation des préceptes managériaux » a ainsi été doublée d'un processus plus général de « managérisation du droit », visant à renforcer la portée normative de celui-ci. En se juridicisant, le management public tend cependant à perdre une part de sa substance et à être phagocyté par la rationalité juridique.
