Recognition of the intellectual property of teachers and researchers: between legislation and reality on the ground[De la reconnaissance de la propriété intellectuelle des enseignants-chercheurs : Entre législation et réalité de terrain]

For research professors, works of the mind are the indicator chosen by the university system as a demonstration of their research activity. Moreover, academic bodies encourage incessantly increasing productivity leading to the dissemination of research results and their valuing, highlighting the gentle and moralist notions of the common good, research community, knowledge sharing... However, unlike other countries, the real objective don't seem to be so disinterested and the actions of certain French institutions - in the perspective of internal financing - could lead to the dispossession of authors' rights to exploit works that ignore the industrial property code. The aim of this article is to establish an inventory of the actual rights of research professors regarding their creations, while presenting examples of de facto steps towards spoliation.
