Abstract

L'hôpital public en France est confronté depuis plusieurs années à des défis majeurs. L'introduction de nouveaux modes de gestion (tarification à l'activité notamment), s'inspirant du secteur privé, marque l'émergence de la notion d'hôpital-entreprise, qui s'inscrit dans le cadre du New Public Management. Par ailleurs, l'hôpital fait souvent face à des difficultés criantes en matière de démographie médicale sur certains territoires. Afin de permettre une transformation du tissu hospitalier, et pour répondre à ces difficultés en mutualisant des ressources entre établissements, le législateur a mis en place plusieurs outils permettant d'engager des recompositions entre hôpitaux voisins, par l'intermédiaire de coopérations et de fusions. Ce sujet est véritablement d'actualité, puisque la loi de modernisation du système de santé (2016), prévoit le regroupement de tous les hôpitaux publics dans des Groupements Hospitaliers de Territoire.
