Abstract

Les conseils des prud'hommes (CPH) sont à présent presqu'exclusivement saisis par des salariés suite à leur licenciement individuel, afin d'en contester le motif. Il s'agit de salariés ayant une certaine ancienneté dans leur emploi, et dont le CDI est interrompu à l'initiative de l'employeur. La prolifération des contrats très courts à durée déterminée (CDD), ainsi que la multiplication des ruptures précoces de CDI - sans que soit utilisée la procédure du licenciement - pourraient bien expliquer la baisse des saisines constatée depuis quelques années, et, à l'avenir, assécher encore davantage les occasions de recours à la justice par des salariés contraints à un rythme accéléré de mobilité professionnelle.
