Abstract

Depuis plusieurs années, et en particulier le Livre blanc de la Commission européenne sur les professions libérales, les règles professionnelles des avocats font l'objet de rudes attaques car elles entretiendraient des situations de monopole. Dans le même temps, on assiste à une emprise de la logique d'entreprise, avec l'émergence de grandes structures d'exercice, et à la construction d'un « marché du droit » par de nouveaux intermédiaires peu contrôlés par la profession. L'objectif de cet ouvrage est de fournir des éléments d'appréciation de ces règles professionnelles et d'expliquer ces évolutions. Pour cela, il s'appuie sur une série d'interviews mais surtout sur une enquête statistique auprès d'un échantillon représentatif de cabinets d'avocats. Première du genre en France, cette étude met à disposition une batterie de statistiques sur les aspects organisationnels : spécialisation et structure par taille des cabinets, turnover des avocats, canaux de prospection des collaborateurs et des clients ; autant d'indicateurs permettant d'apprécier les modes de gestion et de développement des cabinets. Ces résultats originaux sont à même d'éclairer l'action collective de régulation de la profession et d'intéresser les avocats, mais aussi d'autres professionnels, ainsi que tous les étudiants se destinant à une carrière juridique.
