Abstract

Il precesso di controllo dell'economicità e, in particolare, l'esigenza di contenere i costi di produzione, spinge molti imprenditori delocalizzare, le proprie unità produttive in Paesi a basso costo di lavoro. Questo processo pone due problemi di CSR: verso le famiglie dei lavoratori i cui processi sono trasferiti all'estero, e verso il comportamento etico delle imprese subappaltatrici. Nella prima parte il paper analizza il contratto di subappalto e le relazioni economiche e giuridiche che il Committente intrattiene con i suoi subappaltarori esteri. Nella seconda parte l'Autore si interrogha come valutare la CSR del Committente in relazione sia alle sue convenienze economiche sia al rispetto vincolante del diritto. Possiamo parlare di norme volontarie e di norme cogenti ? L'Impresa committente deve accettare i meccanismi per misurare la sua capacità sociale all'estero? Ha l'Impresa i mezzi per costringere i suoi fornitori al rispetto di una "carta" sociale? Se non riesce o non vuole a conformarsi alle esigenze di cui sopra, quali possono essere le conseguenze?
