Abstract

Après avoir présenté les principaux apports des analyses économiques de la concurrence juridique et souligné leur analogie forte avec les analyses de la concurrence sur les marchés de biens et services, cet article examine la pertinence des analyses économiques de la concurrence juridique dans la perspective du droit européen et de la construction européenne. Il s'attache ensuite à déterminer précisément les contextes dans lesquels la concurrence juridique s'exerce effectivement. Enfin, il suggère d'inclure les analyses économiques de la concurrence juridique dans une analyse élargie et enrichie de la construction européenne et des modes de production juridique en Europe.
