Abstract

La déréglementation des professions juridiques intervenant dans les transactions immobilières est préconisée par une étude mettant en exergue la disparité des coûts d'intervention des professionnels dans vingt et un Etats européens. Cette idée ne résiste pas à l'analyse économique du marché et pas davantage à l'analyse juridique. Caractérisé par de fortes asymétries d'information et une grande hétérogénéité, ce marché appelle l'intervention de professionnels différents ou d'administrations diverses selon l'organisation juridique des Etats. Cette diversité prive la comparaison de pertinence. La déréglementation conduirait à la dégradation du service, via la sélection adverse. En Droit, l'étude fait abstraction de la participation des notaires à l'exercice de l'autorité publique, insusceptible de déréglementation. En outre, la CJCE valide les réglementations professionnelles sur les marchés caractérisés par l'asymétrie d'information, dans l'intérêt même du marché et des parties à la transaction.
