Protection des épargnants et des investisseurs : les propositions de l'AMF

Abstract

This article studies a report published by the French financial authority (Autorité des Marchés Financiers (AMF)) about reparation for losses sustained by investors. To enhance reparation of investors, the AMF working group gave its preference for the outof- court settlement in a dispute with a financial intermediary. This settlement benefits from the support of a dedicated Ombudsman inside of the firm or the AMF Ombudsman. To understand solutions proposed and omitted in this report, we describe interests of each party that took part in its elaboration. Taking into account public reactions to this report we assess if the compromise is agreed and if an evolution has been necessary.
