Abstract

La révolution numérique a profondément transformé la façon de produire et d'échanger la connaissance. Internet, nouveau bien commun, a rendu possible la création collective à grande échelle de biens informationnels, comme par exemple les logiciels libres. Ce mouvement s'accompagne d'une redéfinition du statut de l'auteur, et des droits associés, qui remet en cause les modèles économiques traditionnels de l'édition. Comme toute révolution, la révolution numérique suscite des résistances. Nous évoquerons les confrontations en cours et leurs manifestations juridiques, avant de dégager un ensemble de principes fondamentaux devant être garantis dans le monde numérique afin d'y préserver les droits constitutionnels des citoyens.
