Abstract

La mise en oeuvre de l'ouverture à la concurrence de la partie du réseau téléphonique la plus proche du réseau (dégroupage), inspirée par les économistes, mobilise en fait au sein des Autorités de régulation plutôt des compétences de "juges", procédant à de minutieuses instructions et confrontations de points de vue, rendant des arbitrages provisoires, dans l'urgence de l'action. La comparaison des types d'arbitrage entre la France et d'autres pays est à cet égard instructive.
