Restructuring Regulation in Europe. The Case of Air Traffic Services

Abstract

La régulation du trafic aérien est l'une des questions les plus complexes abordées par la Commission européenne pendant ces dix dernières années. D'un côté, la Commission s'est inspirée de son programme de libéralisation tels que mis en oeuvre dans le secteur des télécommunications, des transports ferrovières ou de l'électricité. Elle a cherché à introduire de la concurrence dans un secteur jusque-là dominé par des monopoles d'Etat afin de parvenir à unifier cet aspect du marché européen. Mais, d'un autre côté, cette libéralisation a dû prendre en compte des spécificités du secteur notamment en matière de prérogatives de puissance publique, et en particulier, l'utilisation à des fins militaires de l'espace aérien, les impératifs de sécurité publique, les droits territoriaux des Etats sur leur espace aérien.Cet article présente l'action de la Commission dans ce secteur en soulignant sa capacité à adapter son programme d'action aux spécificités de ce secteur. Au-delà de cet exemple sectoriel, les auteurs soulignent la nécessité de concevoir de nouveaux outils notionnels pour la gestion des infrastructures européennes.
