Abstract

Après une séparation, une proportion importante de travailleurs finit par être réembauchée par leur ancien employeur. La réembauche désigne ainsi le processus par lequel un salarié, précédemment licencié ou placé en chômage temporairement, retrouve son poste auprès du même employeur. Les études sur ce phénomène restent rares sur les marchés du travail européens. De nombreux marchés du travail européens se caractérisent par un dualisme contractuel marqué. Ce phénomène désigne la coexistence de deux régimes de contrats de travail distincts : d'une part, les contrats stables et protégés, généralement à durée indéterminée (CDI), et d'autre part, les contrats précaires et flexibles, souvent à durée déterminée (CDD), engendrant ainsi des inégalités significatives en termes de droits et de sécurité entre les travailleurs. L'objectif de cette étude est d'éclairer le phénomène de réembauche dans le contexte spécifique d'un marché du travail dual, en l'occurrence le marché du travail français.
