Abstract
The result of a collaboration between legal experts and economists, this research responded to a request for an assessment of one of the most important reforms in the area of labour and employment relations introduced in recent years - the 2017 Labour Ordinances. It focuses on Ordinance no. 1387 of 22 September 2017 on the predictability and securitisation of employment relations, and more specifically on (i) the changes made to the rules on dismissal, (ii) the introduction of a mandatory scale for compensation paid by the judge in the event of dismissal without real and serious cause, (iii) collective bargaining agreements (RCC) and (iv) collective performance agreements (APC), our research had two main objectives: Firstly, to analyse the way in which these legal changes have been perceived and mobilised by the various actors concerned; secondly, to assess the impact of the introduction of the compulsory scale and the changes in the rules on dismissals on the behaviour of these actors. These actors are, first and foremost, the employers, through their decisions on hiring and firing permanent employees and their use of the APC and RCC in negotiations with the trade unions; but also the judges of the appellate courts, through their decisions on the amount of compensation for dismissals without real and serious cause.
