Abstract

The present paper aims to propose a new model of mandatory vehicle insurance, the Focused DPVAT. This proposal stems from the risk of discontinuing the DPVAT, as since 2021 private insurers have decided not to offer it anymore. A similar fact occurred with the mandatory DPEM insurance, required by law, but non-existent in practice due to lack of supply. It should also be added that the TCU severely criticized the DPVAT then in force for promoting the profit-inefficiency paradox. The paper presents the functioning of the DPVAT, the theoretical references of the price control models by rate of return and price cap, and performs the diagnosis of the problems of the DPVAT. Based on the diagnosis, the Focused DPVAT is proposed, which will increase the value of compensation for death by more than 9 times. The indemnities for death and disability will be, respectively, of R\$ 123,933.97 and up to R\$ 61,966.99. The targeting allows the nominal collection in 2023 to be 10% lower than in 2016, allowing for reasonable tariffs. At the end, the insurance price control equation is presented through the price cap model.
