O princípio da precaução na OCDE

Abstract

O princípio da precaução não tem um conceito unívoco. Apesar de utilizado em diversos documentos jurídicos, o princípio continua contestado em sua base racional-científica e em sua utilidade na mitigação do potencial de danos ambientais. Acerca dessas duas dimensões, destaca-se a oposição entre a perspectiva norte-americana e europeia sobre o tema. Essa dualidade de perspectivas é identificada, por exemplo, no âmbito da Organização para Cooperação e Desenvolvimento Econômico (OCDE), que, apesar de adotar o princípio em certas circunstâncias, limita sua aplicação. O presente artigo tem o objetivo de analisar a forma como o princípio da precaução é usado na OCDE em seus diversos documentos normativos e nos relatórios analíticos produzidos por seus especialistas.
