Mapeamento das reservas atuais aos Códigos de Capitais e Intangíveis da OCDE

Abstract

Os Códigos de Liberalização de Movimentos de Capitais e Intangíveis (OECD/LEGAL/0002 e OECD/LEGAL/0001) são dois dos instrumentos legais mais antigos e importantes da OCDE. Visam promover medidas de liberalização progressiva e não discriminatória aos movimentos de capitais e intangíveis, além de, ao mesmo tempo garantir mecanismos de flexibilidade e equilíbrio para que os países aderentes possam realizar a liberalização de forma gradual e segura. Uma das formas de proteção prevista nos Códigos é a possibilidade de apresentação e manutenção de reservas, parciais ou totais, à abertura de setores especificados nas listas de compromissos. Em maio de 2017, o Brasil apresentou pedido oficial de acessão à OCDE. Em junho do mesmo ano, solicitou adesão aos Códigos. Considerando que o Brasil está passando pelas etapas do processo de adesão à OCDE e aos Códigos, o presente estudo apresenta um mapeamento geral das atuais reservas apresentadas pelos aderentes aos Códigos, o qual permite verificar e comparar quais itens e quais aderentes apresentam maior ou menor quantidade de restrições.
