La jurisprudencia confirma la indemnización tasada del despido improcedente

Abstract

FEDEA publica hoy una nota de Jesús Lahera, Catedrático Derecho del Trabajo e investigador de FEDEA en la que se comenta la reciente Sentencia del Tribunal Supremo de 19 de Diciembre 2024 que confirma la adecuación internacional de la indemnización tasada y topada del despido improcedente, en línea con lo ya establecido en su día por el Tribunal Constitucional, y se cierra la puerta a que los jueces establezcan indemnizaciones adicionales al margen de la Ley vigente. Si bien la sentencia soluciona un caso en relación con el tratado 158 OIT, es previsible que se mantenga la misma jurisprudencia en relación con el art. 24 CSE, porque siendo de redacción idéntica, es igual de no aplicable directamente una que otra norma internacional, al remitirse ambas a la legislación nacional.
