La fiscalidad energética autonómica y local: Problemática y posibles soluciones

Abstract

El objetivo de este trabajo es analizar la situación de la fiscalidad que recae sobre el sector energético en los ámbitos autonómico y local. Se trata de una fiscalidad muy extensa y objeto de elevada litigiosidad. Por ello, y tras una primera discusión sobre la relación entre los tres ámbitos competenciales – estatal, autonómico y local - se realiza una detallada exposición de los impuestos en los dos últimos. Ese análisis permite obtener una imagen precisa sobre los distintos problemas relativos, por ejemplo, a la doble imposición, la complejidad tributaria y los costes de cumplimiento o a los problemas de afectación a la finalidad medioambiental perseguida, entre otros. El trabajo concluye proporcionando un conjunto de soluciones que permitirían hacer frente al conjunto de problemas detectados.
