Abstract

Before 1997, women experiencing sexual harassment at workplace had to lodge a complaint under Indian Penal Code, 1860, ss. 354 and 509. But the Supreme Court, applying Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), arts. 11 and 24, which the Government of India ratified on 25 June 1993, and the general recommendations of CEDAW in this context with art. 11, came out with a set of lame guidelines which are yet novel to both the employer and the employee and unimplemented due to lack of legislative will
