Competencia y regulación de las telecomunicaciones: el caso de El Salvador

Abstract

El estudio representa un aporte al análisis de la competencia y la regulación de las telecomunicaciones en El Salvador. El documento inicia exponiendo las razones que motivaron la implementación de la reforma en el sector, detalla el marco normativo base aprobado en la Ley y Reglamento de Telecomunicaciones, así como la ley de creación de la Superintendencia General de Electricidad y Telecomunicaciones (SIGET). Dicho marco regulatorio buscaba promover la competencia y para ello se estudia la participación de nuevos operadores en telefonía, se estima el grado de concentración en el mercado por número de líneas fijas y móviles, se comenta la baja penetración de Internet y la estructura de participación de operadores en los servicios de tipo conmutado y dedicado. Por otra parte, se analizan los acuerdos tarifarios y de interconexión que resultan de la reforma, así como la evolución de las tarifas efectivas y máximas aprobadas en líneas fijas, móviles y en los cargos de interconexión entre redes telefónicas. Se estudia también el impacto del DR-CAFTA en el marco normativo del sector y se abordan los nuevos desafíos que plantea la promoción de la sociedad de la información en las telecomunicaciones. Asimismo, se documenta el desempeño del sector, considerando la expansión extraordinaria en el número de líneas fijas y móviles, y se comparara el favorable posicionamiento de El Salvador respecto de América Latina. Finalmente, se plantea un conjunto de recomendaciones enfocadas a impulsar la competencia, una mayor inversión, el desarrollo del sector y el fortalecimiento de la institución reguladora. Competition and regulation of telecommunications : the case of El Salvador Abstract: This report analyses the competition and regulation of telecommunications in El Salvador. It begins by presenting the reasons that motivated the implementation of the reform of the sector, detailing the normative framework approved by the Law and Regulation of Telecommunications, such as the formative law of the Superintendent General of Electricity and Telecommunications (SIGET). As said normative framework seeks to promote competition, the report examines the participation of new telephone operators , estimating the level of concentration in the market by number of landlines and mobile telephone lines, briefly commenting the low penetration of the Internet, and the participation structure of operators for dial up services as well as fixed lines. Additionally, the report investigates the resulting rate agreements and the interconnection of the reform, such as the evolution of effective costs of landlines, mobiles and the interconnection between telephone lines. It also examines the impact of DR-CAFTA, in the normative framework of the sector, presenting the new challenges posed by the promotion of information society on telecommunications. As such, the report describes the performance of the sector considering the extraordinary expansion of the number of land lines and mobile telephone lines, as well as El Salvador's favourable position in comparison to Latin America. Finally, it presents a series of recommendations for promoting competition, increasing investment, boosting the development of the sector and strengthening the regulatory institution. .
