Regulación y competencia en el mercado de medicamentos: experiencias relevantes para América Latina

Abstract

En este estudio se describen las limitantes regulatorias nacionales e internacionales que enfrentan los países latinoamericanos en las adquisiciones públicas de medicamentos patentados y no patentados, así como los principales riesgos de conductas anticompetitivas por parte de las empresas que abastecen a las instituciones de salud. Se analizan las regulaciones internacionales, tanto las que aparecen en el marco del Acuerdo sobre los Aspectos de los Derechos de Propiedad Intelectual Relacionados con el Comercio (ADPIC) como las de algunos Tratados de Libre Comercio firmados por los Estados Unidos (TLCAN y DR-CAFTA) con miras a identificar los espacios que se otorgan a las instituciones responsables de las compras públicas de medicamentos para satisfacer la demanda a los mejores precios de mercado.
