Faiblesses et voies de réforme de la protection de l’emploi en France

Abstract

Ce numéro de Regards économiques soutient que la législation de la protection de l'emploi en France obère les performances économiques tout en contribuant au développement des inégalités sociales. Ce pays se caractérise par des niveaux de protection de l'emploi très différents selon les types de contrats (CDD et CDI). En résulte une segmentation forte du marché du travail entre travailleurs “bien” et “mal” protégés, sans que l'effet net sur l'emploi soit favorable. La solution envisagée par le gouvernement français d'introduire de nouveaux contrats de travail, le Contrat Nouvelles Embauches et le Contrat Première Embauche, ne vont pas dans le bon sens. Une réforme plus ambitieuse, construite autour d'un contrat de travail unique à droits progressifs, permettrait par contre de gommer certaines déficiences actuelles. Une réforme de ce type mériterait certainement d'être réfléchie en Belgique, où il existe de nettes différences de protection de l'emploi entre catégories de travailleurs et de contrats.
