Propuesta para una cuantificación objetiva de los perjuicios inmateriales por responsabilidad extracontractual del Estado: limitando el arbitrio iuris

Abstract

El sistema jurídico colombiano, al igual que otros ordenamientos jurídicos, está enfrentando el desafío de generar una política pública viable y eficaz para cuantificar objetivamente los perjuicios inmateriales. Si bien el órgano de cierre la especialidad Contencioso Administrativa ha intentado enmendar la situación para que no sea sólo el arbitrio judicial el que fije la cuantificación de estos danos, la teoría y metodología expuestas en este proyecto evidencian que: en los procesos de reparación directa, la subjetividad sigue siendo el principio imperante para la asignación de la indemnizaciones. Esto ha generado que existan compensaciones exorbitantes y fallos distintos en casos similares. Por lo anterior, el fin de este proyecto es contribuir al diseno de un modelo que indemnice integralmente a las víctimas, pero que pague esencialmente lo justo. Esta tesis surge del interés conjunto con la Agencia Nacional de Defensa Jurídica del estado, quien proporcionó las bases de datos. ***** The Colombian legal system has been facing a challenge to create an effective public policy for limiting the quantification of inmaterial damages. For this reason, the main purpose of this project is to create a proposal for an objective quantification of non-material damages in state liability for tort. In other words the limitation of judge's discretion in Colombia.
