Indemnizaciones por danos económicos a víctimas directas e indirectas de carteles: marco legal y cuantificación

Abstract

Es común en algunas jurisdicciones que las partes que se vean afectadas por la acción de un cartel demanden compensaciones por los danos económicos causados. Sin embargo, esto no supone que las partes afectadas indirectamente por un cartel (esto es, los compradores de los afectados directos del cartel) hayan visto sus demandas aceptadas por el juez. Este artículo contiene las herramientas para la cuantificación de los danos generados por un cartel aguas arriba a sus compradores directos e indirectos y tiene como propósito ofrecer un marco teórico económico que contribuya a la acción jurisdiccional en Colombia.
