Abstract

La adopción del Estatuto de Roma, aparentemente conveniente desde los hechos históricos quelo anteceden, no fue una empresa fácil debido al comportamiento ambivalente de los Estadosinvolucrados en su concepción y ha sido, además, gravemente criticada por el desconocimiento ensu concepción de las garantías penales fundamentales elaboradas durante siglos por la dogmáticapenal. En esta investigación el autor busca cuestionar si tal proceso de adopción realmente atiendea fi nes de internacionalización de la justicia penal- resaltando su caracterización como sistema dederecho penal- o, si lo que busca es usar algunas instituciones del derecho penal como herramientaspara satisfacer la euforia punitiva y proteger el sistema hegemónico que le sirve de sustento.
