Efectos del Control Constitucional en la Macroeconomía. Estudio de Caso: Sistema pensional Colombiano

Abstract

Se critica a la Corte Constitucional porque su control constitucional sobre los derechos sociales, ha afectado el presupuesto nacional, la asignación de recursos, la equidad y el interés general. La Corte se defiende aclarando que los derechos fundamentales pueden afectarse por el no reconocimiento de derechos sociales, en consecuencia se ha desarrollado una radicalización equívoca del problema, pues el problema no es si deben o no protegerse tales derechos, sino el medio para hacerlo. Sin embargo, la opinión de la Corte frente al sistema pensional, demuestra que no tiene una posición seria sobre el tema, hasta el punto de variar su jurisprudencia sobre la progresividad de los DHESC y de los derechos adquiridos.
