MOBBING: Más acá del derecho, la gobernancia

Abstract

Desde hace algunos años, no muchos, ha comenzado a delimitarse y estudiarse un tipo de conducta dentro de las organizaciones que ha sido denominada con la palabra mobbing. Las consecuencias del mobbing son tales que quien lo sufre experimenta grandes daños morales, físicos y psíquicos que pueden dejar secuelas permanentes en el individuo, entre ellos cuadros de stress, stress postraumático o inclusive llevar al sujeto al suicidio. Estos daños morales, físicos y psíquicos tienen su correlato en las figuras jurídicas de Daño Psíquico y Daño Moral, que tienen apoyatura en un amplio marco legal y que por lo tanto, pueden generar solicitud de reclamos y resarcimientos por parte de los trabajadores hacia las empresas, los que al no poder ser devolutivos del bienestar de la persona, deben ser compensados con indemnizaciones pecuniarias. Ante el panorama descripto, se impone, entonces, la búsqueda de acciones de educación, atención y prevención de situaciones que pudieran dar lugar a dichos reclamos. En este sentido la teoría de la Gobernancia acerca ciertos conceptos y prácticas que pueden ser de utilidad para generar ambientes organizacionales sanos donde las conductas de psicoterror laboral o mobbing no tengan cabida.
