Debate Sobre Funções Sócio-Ambientais Da Propriedade Fundiária E A Noção De Multifuncionalidade Da Agricultura

Abstract

Esse artigo procura traçar paralelos entre o debate da multifuncionalidade da agricultura e a evolução das concepções em torno da propriedade fundiária: de um direito irrestrito à sua função sócio-ambiental. Através da análise histórica de legislações há um esforço no sentido de captar novos sentidos atribuídos as multifunções da agricultura e da propriedade fundiária. Na atualidade, a incorporação de demandas ambientais reorientaram essa discussão, que já demonstra essa perspectiva mais claramente a partir do marco da Constituição Federal de 1988. Outra proposta do artigo, finalmente é aproximar a discussão acerca do tema do desenvolvimento territorial sustentável, propondo a contratualização, dentro da ótica do direito agrário, como ação viável de políticas públicas.---------------------------------------------That article search to draw a parallel between a debate of the multiple functions from agriculture and the evolution of the conceptions into around of the agrarian property: from rights without restrictions, until her social-environmental function. Through of the historical analysis of legislation have a effort in direction in to attract news meanings to award of the multiple functions from agriculture and the agrarian property. In present time, the entry of the environmental necessity, to position in differently way this debate, who already to prove this prospect clearing more from the starting point of the Federal Constitution from 1988. Another proposal of the article, finally is nearness the debate about of the subject from territory sustainability development, proponing the social contract, inside the perspective from the agrarian right, as possibility action from public politics.
