Abstract

Chapter 4 explores the role of soft laws in promoting compliance and coordination in deposit insurance systems, focusing on the BCBS-IADI Core Principles. It explains how these principles influence national authorities through governance networks and international financial institutions, creating incentives to adopt international best practices. The chapter contrasts this with the EU’s Deposit Guarantee Schemes Directive, showing that hard law regimes can face challenges such as incomplete networks, limited scheme funding, and variations across national systems. Vertical networks in the EU partially mitigate these issues, yet national implementation remains decisive. Drawing lessons for ASEAN, the chapter argues that effective deposit insurance systems should combine soft laws with a well-functioning rule of law, strong bank supervision, and coordinated resolution and liquidation procedures.
