Abstract

For businesspeople dealing with China-related transactions and transaction-related disputes, Understanding the Chinese legal framework and legal environment is crucial. A basic understanding of the fundamentals of the legal aspects of commercial activities in China would provide you some insights into planning your conducts and to deal with commercial disputes, and more importantly, to avoid them as much as possible. This chapter briefly introduced the Chinese legal system as a background and then go through three important aspects of solving commercial disputes in China: the choice of law, the contract law, and the dispute resolution methods. Businesspeople who are interested in dealing with Chinese parties will benefit from getting familiar with the unique features of the Chinese law and adjusting their expectations accordingly.
