Abstract

Zusammenfassung Zukunftsgestaltung hängt maßgeblich auch von staatlichen Entscheidungen ab. Für die Ausgestaltung unseres gesellschaftlichen Zusammenlebens stehen den zuständigen Organen und Behörden von rechtlicher Seite große Gestaltungsspielräume zu. Trotz dieser faktischen Gestaltungsmöglichkeiten erweisen sich bisher weder der Staat noch die für ihn tätigen Bediensteten als mutige und innovative Zukunftsgestalter. Dass (und wie) dies dennoch gelingen kann – auch unter schwierigen Rahmenbedingungen – zeigt die 2020 in Bayern geschaffene Rechtsgrundlage für elektronische Fernprüfungen (BayFEV). Hierbei wurde unter maßgeblicher Beteiligung der (Rechts-)Wissenschaft ein Regelungskonzept erarbeitet, welches den Weg zu modernen, berufsnahen und zugleich inklusiven Prüfungen ebnet und so die Zukunft des Hochschulprüfungswesens nachhaltig gestalten kann.
