Abstract

Zusammenfassung Da wettbewerbliche Prozesse bei Nachhaltigkeitsfragen aufgrund von Externalitäten und Informationsproblemen nicht automatisch effiziente Lösungen erreichen, gleichzeitig ein zentrales, kommunales Nachhaltigkeitsmanagement ähnliche interne Kontroll- und Anreizprobleme offenbart, kommt der Rechtsgestaltung eine besondere Bedeutung in der Verhaltenssteuerung zu. Der aktuelle Gesetzentwurf eines Verbandssanktionsgesetzes kann hier nur teilweise überzeugen. Zwar sollen nun die Unternehmen selbst zu internen Ermittlungen durch Inaussichtstellung von Haftungsreduktionen incentiviert werden, gleichwohl ist ein pauschaler Ausschluss von nichtwirtschaftlich orientierten Kommunalunternehmen aus gesellschaftlicher Sicht ebenso wenig zielführend wie eine verschuldensunabhängige Haftung für das betroffene Unternehmen.
