Abstract

Zusammenfassung Immer wieder unterschätzt wird die Bedeutung des Rechts der Allgemeinen Geschäftsbedingungen (AGB). Bestimmte Vereinbarungen können unwirksam sein, wenn sie in AGB festgelegt werden. Das kann für Sie günstig oder ungünstig sein. Wenn Sie diesen Abschnitt gelesen haben, werden Sie vermutlich eine andere Sicht auf so manchen Vertrag haben. Sie werden sich wundern, wie oft Sie es bislang schon mit AGB zu tun hatten, ohne es gemerkt zu haben. Die Unwirksamkeit von Vertragsbedingungen nach dem AGB-Recht ist in der Praxis z. B. wesentlich relevanter als die deutlich bekannteren Beschränkungen der Vertragsfreiheit durch die Regelungen zu „Sittenwidrigkeit/Wucher“ (§ 138 BGB) oder „Treu und Glauben“ (§ 242 BGB).
