Abstract

Zusammenfassung Das deutsche Erbrecht enthält gesetzliche Vorschriften für die Erbfolge, die dann zur Anwendung kommen, wenn nicht der Erblasser von der gesetzlich vorgesehenen Möglichkeit Gebrauch gemacht hat, seine Erbfolge davon abweichend selbst zu regeln. Im ersten Fall sprechen wir vom Eintritt der „gesetzlichen Erbfolge“, im zweiten Fall von der sog Gewillkürten Erbfolge. Die wesentlichen Bestimmungen hierzu finden sich im ersten Abschnitt des Erbrechts (§§ 1924 ff. BGB).
