Abstract

Zusammenfassung Das Kapitel analysiert die Transformation der Technikregulierung von klassischen staatlichen Ansätzen hin zu einem polyzentrischen Governance-System, in dem internationale, private und zivilgesellschaftliche Akteure durch Gesetze, technische Standards und Selbstorganisation normative Rahmen setzen. Es legt dar, wie insbesondere die Architektur digitaler Systeme selbst zu einem mächtigen Regulierungsinstrument wird („Code is Law“), das Verhalten präventiv steuert und traditionelle Rechtsnormen faktisch unterläuft. Diese Machtverschiebung hin zu globalen Technologiekonzernen stellt die etablierten Verfassungsordnungen vor die Herausforderung, die Geltung von Grundrechten im digitalen Raum neu zu definieren, um menschliche Autonomie und demokratische Kontrolle zu sichern
