Abstract

ZusammenfassungDie Gründung einer Genossenschaft verlangt ein stabiles rechtliches Fundament. Das Genossenschaftsgesetz (GenG) sichert Mitbestimmung, Transparenz und Mitgliederrechte und bildet den Rahmen für eine dauerhaft tragfähige Organisation. Historisch aus der Selbsthilfe-Bewegung des 19. Jahrhunderts entstanden, zeigt sich die Genossenschaft heute als moderne, digitale Rechtsform: Von der elektronischen Gründung über hybride Versammlungen bis zur Plattform- und Daten-Genossenschaft verbindet sie rechtliche Verlässlichkeit mit zeitgemäßer Vernetzung. Zentral ist eine klare Satzung mit den gesetzlich geforderten Pflichtbestandteilen sowie ein belastbarer Businessplan. Prüfungsverband und Registergericht sorgen für Qualität und Rechtswirksamkeit; der eGiG-Status ermöglicht frühe Schritte in die Praxis. Wer die „Sprache“ des GenG beherrscht und verständlich kommuniziert, stärkt Vertrauen bei Mitgliedern, Banken und Behörden – und legt die Basis für langfristige Stabilität und Teilhabe.
